Terms of use

1. What this service is, and is not

me.onco.cc (the "Service") is a private notebook. It lets you record information about a cancer case, read your own documents into that record, and see links to public reference pages on onco.cc. It is provided by the operator of onco.cc ("we", "us").

The Service is not medical advice, diagnosis, treatment, or a substitute for any of them. Nothing on the Service, including any text produced by software or artificial intelligence, any link, any list of trials, drugs, guidelines or centres, any summary, timeline, chart or comparison, is a recommendation to take, stop, start, delay or change any treatment or test, or to see or not see any clinician. Always seek the advice of a qualified clinician about any medical question. Never disregard or delay professional medical advice because of anything on the Service.

No doctor-patient, clinician-patient, fiduciary or professional relationship of any kind is created by using the Service. We are not a healthcare provider, health plan, pharmacy, laboratory or clearinghouse, and we do not practise medicine in any jurisdiction.

In an emergency call your local emergency number. The Service is not monitored and must not be used for urgent or emergency communication.

2. Your record and your responsibility

You enter, upload or import the information in your record. You are solely responsible for its accuracy, completeness and currency, for checking every value that software reads from a document before you keep it, and for any decision anyone makes on the basis of it. Automated reading of documents can be wrong, incomplete, out of date or misattributed; the source shown beside a value is an aid to checking, not a warranty of correctness.

You must only upload information that you have the right to upload. If you record information about another person you confirm that you have their permission or another lawful basis, and that you accept responsibility towards them for doing so.

You must be at least 18 years old, or the age of majority where you live if that is higher, to hold an account.

3. Public reference content and links

Links from the Service lead to onco.cc and to third-party sites. onco.cc is an independent public reference which carries its own terms and which may be inaccurate, incomplete or out of date. We do not endorse, and are not responsible for, the content, availability or practices of any linked site, trial, product, institution or person. A link is not a recommendation.

4. Software, artificial intelligence and third-party services

The Service uses third-party providers to operate, including identity (WorkOS), hosting (Vercel), storage and database (Supabase) and artificial-intelligence models (Anthropic) that read documents you choose to have read. Their availability, conduct, security and terms are theirs, not ours, and we are not liable for their acts or omissions. Output from artificial-intelligence models is probabilistic, may be wrong, and is provided for you to check, not to rely on.

5. Availability and changes

The Service is provided as a work in progress. We may change, suspend, withdraw or discontinue any part of it, or the whole of it, at any time without notice or liability, and we do not promise that it will be available, uninterrupted, timely, secure or error-free, or that stored information will be preserved. Keep your own copies of anything that matters to you. You may export or delete your record at any time from Settings.

6. No warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND EVERYTHING IN OR PRODUCED BY IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, OR THAT IT WILL MEET YOUR NEEDS OR PRODUCE ANY PARTICULAR RESULT. NO ADVICE OR INFORMATION, WRITTEN OR ORAL, OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR ANY PERSON INVOLVED IN CREATING, PRODUCING, OPERATING OR CONTRIBUTING TO THE SERVICE OR TO ONCO.CC (INCLUDING OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, LICENSORS AND SUPPLIERS) SHALL BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR ITS USE OR INABILITY TO USE IT, INCLUDING WITHOUT LIMITATION ANY DEATH, PERSONAL INJURY, ILLNESS, DELAYED OR MISSED DIAGNOSIS OR TREATMENT, MEDICAL OR OTHER DECISION, LOSS OF DATA, LOSS OF PROFIT, LOSS OF OPPORTUNITY, DISTRESS, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, STATUTE OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS.

IF, DESPITE THE ABOVE, LIABILITY IS FOUND, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AND TEN UNITED STATES DOLLARS.

Some jurisdictions do not allow certain exclusions or limitations, including for death or personal injury caused by negligence, fraud, or rights that cannot be excluded by contract. Nothing here excludes or limits liability that cannot lawfully be excluded or limited; in those places our liability is limited to the fullest extent the law allows.

8. Assumption of risk and release

You understand and accept that the Service deals with serious illness, that the information in it and linked from it may be wrong, and that you use it entirely at your own risk. To the fullest extent permitted by law you release us and everyone listed in section 7 from all claims, demands and damages of every kind, known or unknown, arising out of or connected with your use of the Service or reliance on anything in it.

9. Indemnity

You agree to indemnify and hold harmless us and everyone listed in section 7 from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the Service, the information you enter or upload, your breach of these terms, or your violation of any law or of any right of another person, including any person whose information you record.

10. Acceptable use

You must not use the Service to break the law, to record information about another person without a lawful basis, to attempt to access another account or another person's record, to probe, scan, overload or interfere with the Service, to extract data other than your own, or to send us anything unlawful, harmful or infringing. We may suspend or close an account that breaches these terms.

11. Intellectual property

The Service, its software, design and text are ours or our licensors' and are protected by law. You keep the rights in the information you enter, and you grant us the licence needed to store, process and display it back to you for the purpose of running the Service. Public reference content on onco.cc carries its own licence.

12. Privacy

How we handle personal and health information is set out in the Privacy Policy, which forms part of these terms.

13. Governing law, disputes and general

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, and any dispute shall be brought exclusively in the state or federal courts located in San Francisco, California, except that we may seek injunctive relief anywhere. If you use the Service from a place whose law gives you rights that cannot be waived, those rights are unaffected.

If any part of these terms is held unenforceable, the rest remains in force and the unenforceable part is enforced to the fullest extent the law allows. Our failure to enforce a term is not a waiver. These terms, with the Privacy Policy, are the whole agreement between you and us about the Service. We may change these terms; the date above shows the current version and continued use after a change is acceptance of it. You may not assign these terms; we may.
